Final Denial for Smart Growth.

The long legal ordeal between Lockport Smart Growth, the Town of Lockport and Walmart may finally have come to an end.

The state’s Court of Appeals denied an appeal by Smart Growth, the name by which local opponents of a Walmart supercenter are known. The court handed down its decision Tuesday, defeating a pair of motions made by Smart Growth.
Upwards and onwards....?

The Buffalo News also reported.

In the wake of the latest court decision, Seaman said the town hopes Walmart can begin construction this year.
A Walmart spokesman said the company hopes to start construction in late summer or early fall.

“There are still, however, some outstanding issues with the current owner of the property,” Philip Serghini said in an e-mail, “which, if not resolved, could extend that timeline.”

Will Smart Growth finally roll over and accept defeat now??? Why do I get the feeling another pointless lawsuit is coming to furthur delay the development. Another lawsuit will serve one purpose and that will be to attempt to delay the project. Let's hope that doesn't happen...

Take a look at the rendering of the new building. Then drive down Transit and look at the old, empty, eyesore of a mall, and tell me which would you rather have???

These hatemongers need to accept the fact that most if not all bought houses to be close to the conviences of Transit Rd.. Now a devloped piece of property is going to get REDEVLOPED and they don't like it, plus a bank roll by a grocery store that has been screwing ALL the people who shop in it for years helped. I'm happy that the mall will be taken down and I will have somewhere else to shop. Good luck TOPS your over priced goods are going to go stale sitting on the shelves. I just hope that the crap Wally World had to go thru to get in here doesn't scare away the other devlopment that usually follows close behind.

Please Walmart management...these small minded, self centered people have never represented the majority of local residents who actually want a choice in shopping options. Looking forward to you breaking ground this spring!

First off, where do you get your statistics regarding the majority of people in this area support this project? To my knowledge, there has never been an official poll regarding peoples opinions regarding this matter. In fact, the closest thing to a poll that I have seen was done by Wal-Mart a couple years ago when they sent out return post cards asking you to return it if you supported the project (they didn't ask for people who opposed it to return the card). The results of Wal-Marts effort was never made public. I'm guessing the return results were not very flattering. As far as this project happening soon, I haven't heard the fat lady has sing yet. Attorneys don't give up easily.

Walmart knows that a new store will most likely take X years and $YYYYYY.YY dollars in litigation. It is part of their cost/planning structure and just another day in the office.

If no one wants the store, it will go out of business and we will have an empty Walmart Super Center instead of an empty mall that is twice the size.

We know the people opposed to the project. Tops owners, Tops management, Tops employees, and the few houses that abut the property.

I just went up the road to the Clarence supercenter and spent $300 and I can tell you, I got plenty more for my money had I spent that at Tops. The price differences are obvious. In these tough times, people need to get as much for their money as possible.

We shouldn't be turning away business that wants to expand and grow in the community. We can't afford to be picky...

Don't forget the unions who see that large population of non-union workers as a giant pit of money just waiting to be snatched up. They'll block any Walmart until it becomes a union shop.

I for one am tired of driving far away to a Walmart and Wegmans. I am sick of overpriced Tops ripping me off. We are not even considering the economy boost from all the builders/developers eating working in our community. What about the jobs it will create at Walmart. Have you seen how many people work at the other Superstores??? On another note...I hope we will still have a Bon-Ton somewhere...anyone know where they will go??

Oh as far as those polls... what a joke..who needs them?? I can't find a person I know in Lockport who isn't happy about this. I think most people will agree its a small group that apposes it and I don't know anyone personally that does...

Walmart has a poll every day that they are open. Don't like it? Don't shop there. That's one vote against. Do like it? Do shop there. That's one vote for.

Actually, there was a poll at www.LockportJournal.com last week. It favored Walmart by more than 92%.

Webpolls are as worthless as any sort of measure other than the number of people who like to respond to webpolls.

BonTon is not moving and would receive facade improvements.

The resulting property split is why a good portion of the waivers were needed. For some reason Buildings are not allowed to touch or be to close to one another. I think it has to do with N1H1 or something....
